Welcome to Safe2Serve! By accessing our website, mobile app, and services, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully.


1. Definitions

  • “We,” “Us,” “Our” refers to Safe2Serve.
     
  • “You,” “Your” refers to the user of our website, app, or services.
     
  • “Services” refers to all services provided by Safe2Serve, including our mobile app, consultancy, on-site inspections, monthly audits, and online store.
     

2. Use of the Website and App

  • By using our website or downloading our app, you confirm that you are at least 18 years old and eligible to enter into these Terms and Conditions.
     
  • You agree not to use the website or app for any unlawful purpose or in a way that could damage, disable, or impair our services.
     

3. Registration and Accounts

  • To access certain features of our app and services, you may be required to create an account. You agree to provide accurate and complete information and to update it as necessary.
     
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
     

4. Services and Appointments

  • Our consultancy services include on-site inspections and monthly audits to assess food safety compliance. By booking an appointment, you agree to provide accurate information about your premises and to ensure safe access for our consultants.
     
  • No Refunds on Deposits: All deposits paid for appointments or services are non-refundable. If you need to reschedule, please contact us at least 48 hours in advance.
     

5. Online Store and Orders

  • When you purchase products from our online store, you agree to provide accurate shipping and billing information. Orders will be processed promptly, and shipping times will be communicated at checkout.
     
  • We reserve the right to cancel or refuse any order at our discretion. If an order is canceled, any payment made will be refunded in full.
     

6. Intellectual Property

  • All content on our website and app, including text, graphics, logos, and software, is the property of Safe2Serve and is protected by copyright and trademark laws.
     
  • You may not reproduce, distribute, or create derivative works from any content without our explicit permission.
     

7. Limitation of Liability

  • Safe2Serve will not be liable for any direct, indirect, incidental, or consequential damages arising from the use of our website, app, or services.
     
  • Our total liability to you for any claim related to these Terms and Conditions shall not exceed the amount paid by you for the services in question.
     

8. Privacy

Your use of our website, app, and services is subject to our Privacy Policy, which explains how we collect, use, and safeguard your personal data. By agreeing to these Terms, you also consent to our data practices as outlined in that policy.

9. User Responsibilities

By using Safe2Serve’s platform, you agree to:

  • Provide accurate, current, and complete information.
     
  • Use the app only for lawful compliance and business purposes.
     
  • Not upload or submit false, misleading, or malicious data (e.g. fabricated logs).
     
  • Refrain from attempting to gain unauthorized access to our systems or data.
     

We reserve the right to suspend or terminate access if these terms are violated.


10. App Usage and License

  • Safe2Serve grants you a limited, non-exclusive, non-transferable license to use the app solely for your business operations and in accordance with these terms.
     
  • You may not reverse-engineer, decompile, or attempt to access the app’s source code.
     
  • All intellectual property in the app remains the sole property of Safe2Serve.
     

11. Subscriptions and Payments

  • Some features of the Safe2Serve app require a paid subscription. Prices are displayed on our website or provided during onboarding.
     
  • Subscription payments are handled via our secure third-party payment processor (e.g. Stripe) and are managed outside the Apple App Store and Google Play to avoid in-app fees.
     
  • Subscriptions are billed monthly or annually, depending on your plan. You can cancel at any time, but refunds will not be issued for partial billing periods.
     

12. Cancellation and Termination

You may cancel your subscription or service at any time by contacting us in writing. We reserve the right to suspend or terminate your account if:

  • You violate these Terms or any applicable laws.
     
  • You fail to pay fees due for paid services.
     
  • We suspect fraudulent or harmful activity.
     

Upon termination, your access to the app and services will end, but certain obligations (e.g. outstanding payments, legal rights) will survive.


13. Disclaimers

  • Our tools and services are designed to assist with food hygiene compliance but do not guarantee a specific outcome (e.g. a 5-star rating).
     
  • Final compliance status is determined by local authorities and environmental health officers (EHOs).
     
  • We are not liable for decisions made by external regulators based on your premises’ conditions or staff behaviour.
     

14. Force Majeure

Safe2Serve is not liable for any delay or failure in performance resulting from events beyond our reasonable control, including but not limited to natural disasters, pandemics, internet outages, strikes, or government restrictions.


15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.


16. Changes to These Terms

We may update these Terms from time to time. Significant changes will be notified on our website or via email. Continued use of the site or app after changes are posted constitutes your acceptance of the revised Terms.

Return, Refund & cancellation Policy

 

1. Digital Services (App Subscriptions & Consultancy)

A. App Subscriptions

  • We offer monthly and annual plans for access to our food hygiene compliance app.
     
  • Because subscriptions grant immediate access to a digital service, no refunds will be issued once a payment is processed.
     
  • You may cancel your subscription at any time, but access will continue until the end of the paid billing cycle.
     
  • Subscriptions are managed externally via [Stripe/your payment platform] and are not subject to Apple or Google Play refund policies.
     

B. Consultancy Services (Audits, Site Visits, etc.)

  • Appointments may be rescheduled with at least 48 hours’ notice.
     
  • Deposits are non-refundable, as they cover the cost of scheduling and preparation.
     
  • If we are unable to attend a confirmed appointment due to unforeseen circumstances, we will either:

    • Reschedule the visit at no additional charge, or
       
    • Provide a full refund of the deposit, at your choice.
       

2. Physical Products (e.g. Equipment, Cleaning Supplies)

A. Eligibility for Return

  • You have the right to return unused physical products within 14 days of delivery under the Consumer Contracts Regulations.
     
  • To be eligible for a return, items must be:

    • Unused and in their original packaging
       
    • In resalable condition
       
    • Accompanied by proof of purchase
       

B. How to Return

  • Contact us at [Insert email] with your order number and reason for return.
     
  • Once approved, you will receive return instructions.
     
  • You are responsible for the return shipping costs unless the item is faulty or incorrect.
     

C. Refunds for Returns

  • Once we receive and inspect your returned item, we will notify you of the approval or rejection.
     
  • Approved refunds will be processed to your original payment method within 5–10 working days.
     
  • Shipping charges are non-refundable unless the return is due to our error.
     

3. Damaged, Faulty, or Incorrect Items

  • We will arrange for a replacement or refund and cover any return postage costs where applicable.

4. Non-Returnable Items

  • Used equipment
     
  • Downloaded content or activated software
     
  • Services already delivered or fulfilled (e.g. completed audits)
